These Terms Of Service ("Agreement") governs the use of the Mingles.com Service ("Service") produced by Mingles.com, LLC. ("Service Provider"). You can access this Agreement at any time from the help page of the Service. Please read these rules carefully. Your accessing, posting of, responding to a profile, use of the forums and chat rooms, and/or use of the Mingles.com email and instant messaging system will constitute your agreement to comply with these rules. If you cannot agree with these rules, please do not use the Service.

This Service is for adults only. You must be 18 or older to use this service.

Mingles.com, LLC does not necessarily endorse, support, sanction, encourage, verify, or agree with the comments, opinions, or statements posted by users in their profiles, forums, chat rooms, or elsewhere. Any information or material placed in the profiles, forums, chat rooms, or elsewhere, including advice and opinions, are the views of those who post the statements, and do not necessarily represent the views of Mingles.com, LLC.

Everyone who wishes to post a profile is required to provide accurate email address information. (To confirm your email address, Mingles.com will send you a confirmation e-mail. The posting of your profile is contingent upon your response to this email.)

You acknowledge that Mingles.com, LLC has not reviewed and does not endorse the content of all sites linked to from this Service and is not responsible for the content or actions of any other sites linked to from this Service. Linking to any other service or site from this Service is at your sole risk.

You agree that the Service Provider is not responsible, and shall have no liability to you, with respect to any information or materials posted by others, including defamatory, offensive or illicit material. You agree not to use any obscene, indecent, overtly sexual, or offensive language, or to place on the Service any material that is libelous, abusive, harassing, annoying, or hateful, or that constitutes unauthorized advertising, invades anyone's privacy, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law or regulation. You agree not to post any email addresses, or any URLs of other web sites, on the service.

Profiles and other material on this site are for your personal use only. The Service contains copyrighted and other proprietary information. You may not in any way make commercial or other unauthorized use, by publication, re-transmission, distribution, or otherwise, of profiles or other material obtained through the Service, except as permitted by the Copyright Act or other law.

Other than connecting to Service Provider's servers by HTTP requests using a Web browser, you may not attempt to gain access to Service Provider's servers by any means including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Service or otherwise.

You agree not to disrupt, modify or interfere with the Service or its associated software, hardware and servers in any way, and you agree not to impede or interfere with others' use of the Service. You further agree not to alter or tamper with any information or materials on, or associated with, the Service.

Postings to the Service are not private. You grant Mingles.com, LLC the unrestricted right to use, reproduce, modify, translate, transmit, publish, and distribute any material you post to the Service in any medium (now in existence or hereafter developed), and for any purpose, including commercial uses, and to authorize others to do so.

By posting you certify that you have given Mingles.com, LLC permission to release all profile information given by you in the personal profile form.

You agree to indemnify Mingles.com, LLC, the Service provider, and its employees, agents, and representatives, and to hold them harmless, from any and all claims and liabilities (including attorneys fees) which may arise from your submissions, from your unauthorized use of material obtained through the Service, or from your breach of these rules, or from any such acts through your account. You further agree that the above parties are not responsible, and shall have no liability to you, with respect to any material posted by others. Mingles.com, LLC does not verify any information posted to the Service by users or others, excepting email address, or guarantee the proper use of such information by any party. Mingles.com, LLC does not review or assume any responsibility for the content of private email messages, instant messages, or chat room messages, sent between members using this service. We do not ensure that these messages may not contain material that could be offensive to some. Mingles.com, LLC does not monitor or resolve disputes between Service users. Mingles.com, LLC does not ensure secure transmissions over the Internet. You should not post your or any other person's telephone numbers, street addresses, last names, or email addresses in your profile or profile. Reminder: The people you meet in Mingles.com personals are strangers. You are responsible for guarding your personal information. If you decide to meet anyone in-person, please use good judgment and common sense. Mingles.com, LLC suggests that you always plan to meet in a public place and, if possible, in a group setting. The Service provider reserves the right, but undertakes no duty, to review, edit, move, or delete any material provided for display or placed in its profiles and/or forum areas, in its sole discretion. Mingles.com, LLC does not ensure that offensive material will be removed from the Service. The Service Provider reserves the right to post, from time to time, additional rules of usage that apply to specific parts of the Service. Such additional rules will be posted in the relevant parts of the Service, and will be clearly identified. Your use of the Service constitutes your agreement to comply with these additional rules. YOU ACKNOWLEDGE THAT YOU ARE USING THE SERVICE AT YOUR OWN RISK. THE SERVICE IS PROVIDED "AS IS," AND THE SERVICE PROVIDER AND ITS AFFILIATES HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, TITLE, MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION CONTAINED THEREIN OR PROVIDED BY THE SERVICE.

SERVICE PROVIDER AND ITS AFFILIATES DO NOT REPRESENT OR WARRANT THAT ACCESS TO THE SERVICE WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED ON THE SERVICE.

THE SERVICE PROVIDER AND ITS AFFILIATES SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ALLEGEDLY SUSTAINED ARISING OUT OF YOUR ACCESS TO OR INABILITY TO ACCESS THE SERVICE, INCLUDING FOR VIRUSES ALLEGED TO HAVE BEEN OBTAINED FROM THE SERVICE, YOUR USE OF OR RELIANCE ON THE SERVICE OR ANY OF THE INFORMATION OR MATERIALS AVAILABLE ON THE SERVICE, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

Service Provider has the right to terminate your ability to access the Service, for any reason, without notice. You agree that this Agreement, for all purposes, shall be governed and construed in accordance with the laws of the State of New Jersey applicable to contracts to be wholly performed therein, and any action based on or alleging a breach of this Agreement must be brought in a state or federal court in New Jersey. In addition, you agree to submit to the personal jurisdiction and venue of such courts. This Agreement is the complete and entire agreement between the parties and supersedes any prior agreement, whether written or oral.
